CONDENSED TOS
NOTICE: This is the CONDENSED version of the TOS.Detailed info may be missing. The sole purpose of this condensed version is for the Customer to have an easy overview of the main points. Please refer to the full TOS below for more detailed terms, which WILL apply to your orders.

TERMS OF SERVICE
LAST UPDATE: 9/15/2024This contract applies to anyone who has purchased artwork from the artist. By ordering work from the artist, the Customer agrees to the following terms and conditions:PAYMENTS
1. Customer agrees to pay the due amount upfront. If, for any reason, the customer cannot pay the full price at one time, message me and we will work something out.
2. Customer accepts that work on the artwork will not be started until payment has been received by the artist according to the above schedule.
3. Payment is to be made only through VGen or Etsy. Paypal and card can be used on both sites, and it is easier for me to track commissions there.PRODUCT DELIVERY
4. Customer agrees that the finished product will be delivered digitally to the provided email address. The finished product can also be uploaded to Toyhouse if requested.
5. Any other method of delivery has to be mutually agreed before the work commences. Note that there is no physical product.
6. It is sole responsibility of the Customer to propose a delivery method which works for both parties. The artist cannot be held accountable for the Customer's loss of access to the delivery method, loss of delivered files, impediments such as spam filters or any other technical obstacles outside responsibility of the artist.
6b. Upon delivery of the product, it is the Customer's responsibility to store it properly. Loss of product due to negligence will not be reimbursed by the artist. We can not guarantee that the original copy of the product will be available in the case that the Customer lost their files.REVISIONS
7. Customer has the right to 3 complete revisions before being completed.
8. Customer has right to a reasonable amount of minor edits after completion, such as changing an eye color or fixing a small detail. Any requests above that, however minor, will require a prior mutual agreement and may result in an increase of order value. Any such increase will be invoiced separately. Work on any such excessive requests will not commence until the payment for the additional invoice(s) has been received.CURRENCY CONVERSIONS
9. Customer agrees to pay the total amount specified in USD.
10. It is the sole responsibility of Customer to bear any currency conversion costs, bank transfer fees, payment provider service fees and any other costs involved in transferring funds to the Seller. Note that both VGen and Etsy automatically convert currencies, but may result in the original price being higher due to conversion fees.
11. Payment is considered as received and completed only when the total amount is received.REFUND POLICY
12. Customer has right to request a full refund if a sketch has not been provided within 6 weeks, or when the product has not been completed within three months. Refund conditions for commissions which require more work must be agreed separately, before the work commences. These provisions exclude work interruptions caused by unforeseen circumstances such as illness, accident or any other credibly documented reason for interruption of work.
13. Customer obliges to contact the artist in a fast and responsive manner, responding swiftly to any requests for comments, clarifications, opinions, validation of progress etc. Lack of timely communication on behalf of the Customer will be recognized as implicit approval of all work progress and current state of the art.PERSONAL AND COMMERCIAL USE
14. The work received by the Customer is for personal use. Any use of the artwork for commercial purposes, reselling it, reproduction or publishing for reasons other than personal purposes has to be approved beforehand by the Seller. This will require a separate agreement between the customer and the artist defining exact conditions and financial implications of such use of the artwork.Customer does not hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.In addition, the customer does not hold the right to use the product for AI datasets or for AI tools and any present or future inventions in the space.CANCELLATIONS
15. The artist reserves every right to refuse or cancel any order, under condition of full refund, without giving reasons to the Customer.
16. Any disrespectful behavior will not be tolerated and may result in a cancellation of the order. Customer will receive full or partial refund depending on amount of work completed. We will have full right to refuse any service to the Customer in the future.EXTRA NOTE FOR ART TRADES
This will apply to anyone requests to do an art trade with us.
17. When agreeing to doing a trade, please inform the artist of any specific pose or scene you want.
18. In between commissions and trades, we work on personal art so we don’t get burnt out. The artist will ALWAYS add you to our Trello queue, and you will be able to see when we will start yours and the progress. Artist will also inform of any delays.
19. When doing a trade with the artist, communicate with us. If you don’t have a queue and it’s been months and we have gotten no update, we are going to get suspicious.
20. If more than 3 months have passed and you have not provided at least a progress sketch, you will be blacklisted from using our side if we've already sent it. The blacklist will be lifted once you complete your side. If you use our art while you are blacklisted, the artist will ask you to delete or will file a copyright report, as the terms are stated clearly.
